These Terms of Service ("Terms") govern your access to and use of the SyncLeads website and lead generation services operated by SyncLeads ("Company," "we," "us," or "our"). By accessing or purchasing from sync-insure.com, you agree to be bound by these Terms.

1. Services

SyncLeads provides lead data for health insurance, life insurance, and annuity professionals. Leads consist of consumer contact information collected via consent-based opt-in forms. We do not guarantee any specific sales results or conversion rates.

2. Eligibility

You must be at least 18 years old and a licensed insurance professional or authorized business representative to purchase leads. By using our services, you represent that you meet these requirements.

3. Permitted Use

Purchased lead data may only be used for lawful insurance marketing purposes. You agree not to:

• Resell, sublicense, or transfer lead data to third parties without written consent
• Use leads for any purpose other than direct insurance marketing
• Contact consumers on the National Do Not Call Registry in violation of applicable law
• Use automated dialing systems without ensuring TCPA compliance
• Harass, threaten, or engage in deceptive practices with consumers

4. TCPA Compliance

You are solely responsible for your own compliance with the Telephone Consumer Protection Act (TCPA) and all applicable federal and state telemarketing laws. SyncLeads provides leads generated through consent-based forms; however, the buyer bears full legal responsibility for all communications made to those consumers. SyncLeads shall not be liable for any TCPA violations committed by purchasers.

5. Payment and Refunds

All purchases are final unless a lead replacement guarantee applies under your plan. Lead replacements are issued for invalid contact information or leads that fall outside agreed filter criteria — not for failure to convert. Chargebacks initiated without prior resolution attempt may result in account suspension.

6. Lead Replacement Guarantee

Growth and Enterprise plan customers are eligible for lead replacements where: (a) the phone number is non-working or invalid; (b) the lead does not match the agreed geographic or demographic filters; or (c) the contact information is demonstrably inaccurate. Replacement requests must be submitted within 7 days of delivery.

7. Disclaimer of Warranties

Our services are provided "as is" without warranties of any kind, express or implied. We do not warrant that lead data will result in sales, that all consumers will respond, or that the service will be uninterrupted or error-free.

8. Limitation of Liability

To the maximum extent permitted by law, SyncLeads shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services, including lost profits or business opportunities. Our total liability shall not exceed the amount paid by you in the 30 days preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless SyncLeads, its officers, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of lead data, your violation of these Terms, or your violation of any applicable law.

10. Termination

We reserve the right to suspend or terminate your account at our discretion if we reasonably believe you have violated these Terms or applicable law.

11. Governing Law

These Terms are governed by the laws of the United States. Disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.

12. Changes to These Terms

We may update these Terms at any time. Continued use of our services after changes constitutes acceptance of the revised Terms.
